The African National Congress (ANC) in South Africa’s Eastern Cape province is grappling with significant delays to its 10th provincial conference, stemming from ongoing legal battles and internal disputes. Lulama Ngcukayitobi, the ANC’s provincial secretary, described the situation as “unfortunate,” acknowledging that the party is “currently struggling to deal with them.” These challenges center on a contempt of court application and an appeal against an interim injunction that halted the conference, originally scheduled for this weekend.

Court Postponement and Legal Complexities

On Saturday, the Ku-Gompo City High Court postponed the contempt of court application and removed it from the emergency list, further prolonging uncertainty. Ngcukayitobi, speaking to media, emphasized the provincial leadership’s commitment to ANC constitutional processes. “We seek to comply with every single aspect of the policies, constitution and policies of the ANC that guide us in convening the conference,” he stated, adding that they “accept the findings of the court and abide by them.”

Despite this, Ngcukayitobi expressed confidence in the party’s legal team, noting they are being “guided properly.” However, he admitted that the timeline for the highly competitive conference remains unclear: “I don’t know when it will take place. The matter is in court.” This postponement disrupts a critical event for the ANC, where provincial leadership is elected, influencing national dynamics ahead of the 2024 general elections.

Internal Grievances and National Leadership Response

The legal saga is intertwined with internal party tensions. Over a week ago, Ngcukayitobi formally raised concerns in a 10-page letter to the ANC’s National Executive Committee (NEC), questioning the processes leading up to the conference. This move highlighted rifts within the party’s structures. ANC secretary-general Fikile Mbalula, addressing media on Monday, countered that Ngcukayitobi should have resolved these grievances through proper internal channels rather than public or legal avenues.

Ngcukayitobi defended his actions, stating: “These matters are still pending between me and the national officials, so they cannot be resolved other than this.” He confirmed no scheduled meeting with the NEC has been set, partly due to the letter and the conference postponement, with plans to formally request a meeting. This standoff underscores broader challenges in the ANC, where factional disputes often spill into courts, as seen in similar cases like the 2022 KwaZulu-Natal conference delays.
