Constitutional Court Upholds King Misuzulu’s Reign

Background

In 2022 President Cyril Ramaphosa recognized Prince Misuzulu kaZwelithini as the official king of the AmaZulu nation. Some members of the royal family, led by Prince Mbonisi kaBhekuzulu, challenged that decision, saying it did not follow traditional customs.

The Legal Battle

  • December 2023: Judge Norman Davis sided with Prince Mbonisi, overturning the president’s recognition.
  • Supreme Court of Appeal (SCA): Reversed Judge Davis’s ruling, affirming Misuzulu as king.
  • February 2024: The Constitutional Court refused to hear a direct appeal, saying there was little chance of success.
  • April 2024: Prince Mbonisi and 23 other royals asked the Constitutional Court to cancel its earlier decision and let them argue again.

Court’s Decision

On Friday the Constitutional Court announced it would not change its mind. The judges said no new reasons were given to overturn the earlier ruling. The judgment read:

“The Constitutional Court has concluded that no case has been made out for a rescission, therefore the application must be dismissed with costs.”

Prince Mbonisi’s Argument

Prince Mbonisi claimed the meeting that chose Misuzulu included people who were not royal family members, so the selection was not valid. He quoted a past case (Mothulwe vs the Labour Court) where the Constitutional Court had agreed to reopen a matter, arguing his situation met the same test. He also said the lower courts ignored the principle that past decisions are not always final.
