South Africa’s AI Policy Landscape: Balancing Innovation and Legal Reality

While South Africa’s government works to finalize a comprehensive national artificial intelligence (AI) policy framework, legal experts warn that businesses operating in the country are already navigating a complex and risky environment. The immediate challenge is not a lack of rules, but the application of decades-old laws to transformative new technology. On Wednesday, Cabinet took a significant step by approving a draft national AI policy for public comment, a crucial precursor to formal legislation. According to the government’s statement, the policy aims to strengthen the state’s capacity to regulate and adopt AI responsibly, while simultaneously promoting local innovation, supporting job creation, and improving access to critical AI skills.

Existing Laws Apply: The Foundational Legal Risks

“Like most countries, South Africa is trying to understand the impact of AI before formulating policies and regulations,” said Darren Olivier, a trademark attorney and partner at the established law firm Adams & Adams. “But that doesn’t mean AI is unregulated. Existing laws—including those on copyright, patents, and data protection—already apply to how AI is used and what it produces.” For decades, companies have relied on a stable intellectual property (IP) framework: trademarks to protect brands, copyrights for creative works, and patents for inventions. Although these foundational laws were not written with AI in mind, Olivier emphasizes they remain fully applicable, creating immediate and tangible risks for organisations.

Key Risk Areas for Businesses Using AI

The practical dangers are multifaceted. One critical risk involves the inadvertent compromise of trade secrets. An employee entering confidential company information, source code, or proprietary data into a public or poorly secured AI system may fundamentally undermine its legal protection as a trade secret. Another major area is copyright infringement. AI-generated content, from marketing copy to software code, can directly violate copyright law if the training data included protected works used without permission. Olivier points to ongoing litigation in the United States, where authors and publishers have sued AI developers for alleged unauthorized use of copyrighted material to train their systems—a precedent that could influence global jurisprudence.

The “Black Box” Problem: Transparency and Training Data

One of the biggest and most persistent risks is the lack of transparency regarding the data used to train many commercial AI models. If training materials contain copyrighted books, music, architectural designs, or software code used without a licence, the outputs can perpetuate this infringement. This places legal exposure squarely on the end user—the company deploying the AI tool—not just the developer. “We need regulation because AI is so powerful—and in many cases even worrying,” Olivier analogized. “It’s like having a Lamborghini in the garage without a license, without knowing the rules of the road, and with a foggy windshield.”

Proactive Governance: From Risk Mitigation to Value Creation

Faced with these clear and present dangers, some forward-thinking companies are already responding by adopting internal AI governance frameworks. They are treating AI not merely as an IT efficiency tool but as a significant business risk that requires active, ongoing monitoring and clear policies. “It’s not just about risk reduction,” Olivier stated. “It’s also about creating value and building trust.” Companies that implement robust governance—covering data input protocols, output verification, and employee training—are likely to foster stronger relationships with customers, regulators, and investors. While definitive regulatory answers are still evolving, Olivier asserts that fundamental principles and best practices can and should be implemented immediately.

Building a Responsible AI Framework: Foundational Steps

Based on current legal understanding, a basic internal AI governance approach should include:

  • Clear Usage Policies: Defining approved tools, acceptable data inputs (especially prohibiting confidential/trade secret data in public models), and approved use cases.
  • Output Vetting: Implementing processes to verify AI-generated content for potential IP infringement, accuracy, and bias before public or commercial use.
  • Vendor Due Diligence: Scrutinising AI providers’ terms of service, data sourcing practices, and indemnification clauses.
  • Employee Training: Educating staff on the legal risks and company policies surrounding AI tool utilisation.

“No one has all the answers yet,” Olivier conceded, “but these are the basic building blocks for responsible adoption.”

Africa’s Distinctive Opportunity in the Global AI Race

As global regulators and corporations grapple with AI’s complexities, South Africa and the broader African continent have a unique window to shape their own AI future. Currently, much of Africa remains on the periphery of the global AI value chain. The leading foundational models are predominantly developed in the United States, Europe, and China, frequently trained on datasets that poorly reflect local languages, contexts, and socioeconomic realities. This gap presents a substantial opportunity for home-grown innovation.

Leveraging Entrepreneurial Culture for Localised Solutions

Olivier highlights Africa’s strong entrepreneurial and problem-solving culture, forged under challenging conditions, as a key asset. “Africa has innovation in its DNA. We are entrepreneurial by nature and that makes the continent fertile ground for AI development,” he said. Coupled with a comparatively less restrictive regulatory environment for experimentation than in some Western markets, this could allow African organisations to develop tailored AI tools that solve local problems—from agricultural diagnostics in indigenous languages to fintech solutions for underbanked populations. This mirrors how the continent leapfrogged traditional banking infrastructure through the rapid adoption of mobile money technology. The nascent AI policy framework, if crafted to enable rather than hinder this spirit, could position Africa not just as a consumer of global AI, but as a creator of contextually intelligent solutions.
