A Massive Legal Battle Over Diamond Land
What Happened?
A state-owned diamond company called Alexkor and its partner, the Richtersveld Mining Company (RMC), are now facing a huge R500 million lawsuit. The claim comes from another mining company, Vast Mineral Sands (VMS).
The fight started because Alexkor wouldn’t let VMS onto a huge piece of land—over 82,000 hectares of sand dunes—in the Richtersveld area of the Northern Cape. VMS had the legal right to explore (prospect) for valuable minerals there since 2018.
The Big Damages Claim
In 2025, VMS sent a legal letter demanding R520 million in damages. They say Alexkor’s refusal to let them on the land caused massive problems.
An actuary (a financial expert) broke down the claimed damages:
- Waste-related losses: R72.9 million
- Mining-related losses: R428.8 million
- Lost investment chances: R13 million
- Rent for a building Alexkor used: R540,000
- VMS’s legal costs: R4.5 million
- Travel costs for directors: R35,172
VMS first asked for R612 million but reduced it to R520 million after talking with Alexkor.
Why This Land Matters
The minerals VMS was looking for—like leucoxene, monazite, rutile, and zirconium—are super important. Major countries like the US, India, and Australia need them for high-tech gadgets, defense gear, and green energy technology like wind turbines.
VMS got its prospecting right in 2018 for five years and had it renewed until 2026. The land is co-owned by Alexkor, RMC, and a communal property association representing local communities.
The Long Legal Fight
- 2019: Alexkor suddenly blocked VMS from the land, saying the permits were wrong.
- Before Court: Two official dispute meetings (under the MPRDA law) both said VMS was right, but Alexkor still refused access.
- August 2023: VMS won an urgent court case in Kimberley forcing access.
- After That: Alexkor lost every appeal. They took it to the Constitutional Court in January 2025, but the highest court dismissed the case, saying it had no chance of winning.
- Result: Alexkor was ordered to pay legal costs in multiple lost cases.
A Split Within the Team?
The joint venture seems to be cracking. The community property association (CPA) that co-owns the land says it warned Alexkor not to fight the case.
“They ignored the advice and persisted with the litigation until the highest court in the country confirmed the views of the community. The litigation was not justified.”
The CPA also pointed out that another company with similar rights was allowed to operate without issues. They’re confused why Alexkor treated VMS differently.
What the Companies Say
Alexkor’s Chair, Dineo Peta: Said Alexkor followed all legal channels on advice from lawyers. “The denial of access to VMS would have been in line with board decisions… taken at the time.” She wouldn’t explain the reasons yet, saying they’ll wait for Parliament and the Mineral Minister to decide.
VMS’s Statement: The courts “expressly confirmed” that Alexkor’s actions caused them “irreparable harm.” They argue Alexkor ignored the legal regulator and wasted public money by losing six court cases, including at the Constitutional Court. This stalled economic development in a region with very high unemployment.
The Community’s Loss
Local community reps are frustrated. The nearly 30-month legal battle meant no jobs.
“There are very few work opportunities in the Richtersveld,” the CPA said. “By now, VMS could have been operational and created work for the community.”
VMS had promised to hire locals and was negotiating a shareholding deal for the community.
