What Is the Office of the IDAC Oversight Judge?

The Office of the IDAC Oversight Judge is a new body created to watch over the Investigating Directorate Against Corruption (IDAC). It was set up under Section 22A of the National Prosecuting Authority Amendment Act. Its main job is to make sure that IDAC’s investigations are carried out lawfully, fairly and openly.

Who Leads the Office?

Retired Judge Takalani Joseph Raulinga is the person in charge. He explained to the media that the office works independently but still answers to the Minister of Justice and Constitutional Development and, ultimately, to Parliament through the Portfolio Committee on Justice and Constitutional Development.

What Does the Office Do?

Handle Complaints

The office can look into complaints about:

  • Prosecutors working with IDAC
  • Investigators and deputy directors
  • Seconded officials and other staff that support IDAC

It deals with issues related to serious, high‑profile or complex corruption, commercial crime and financial crime. This includes matters that come from commissions of inquiry, statutory referrals or ordinary members of the public.

What It Does Not Do

The office does not investigate intelligence matters – that remains the role of the Inspector‑General of Intelligence. It also does not take away any powers from the South African Police Service or the Directorate for Priority Crime Investigation.

How Complaints Are Processed

  1. Submission – Anyone, inside or outside the government, can send a complaint. Whistleblowers are protected by the Protected Disclosures Act.
  2. Assessment – The office first checks whether the complaint falls within its mandate.
  3. Referral – If it does not, the matter is sent to the appropriate institution.
  4. Investigation – If it does, the office investigates and then the judge reviews the findings and makes recommendations according to the law.

Where Can You Send a Complaint?

Although the office is based in Pretoria, it accepts complaints from anywhere in South Africa. Right now you can submit complaints electronically. A secure drop‑box is planned for the SALU Building once the physical offices are ready.

Staying Independent and Accountable

The office reports to the Minister of Justice and Constitutional Development and is answerable to Parliament. This setup is meant to keep it independent while still being constitutionally accountable.

What About Ongoing Cases?

Judge Raulinga said the office will not comment on active commissions of inquiry or court cases. Any complaint that falls within its mandate will be handled objectively and according to the law.

Looking Ahead

The office plans to:

  • Talk to stakeholders and build relationships with other institutions
  • Give the public updates when appropriate
  • Encourage both public servants and ordinary citizens to report matters that belong to its mandate
