Lawyer Removed from Register After a Decade of Non‑Compliance
What Happened?
The South African Legal Practice Council (LPC) removed the name of Schalk Willem Botha from its official list of lawyers. Botha did not contest the decision and agreed to be taken off the register.
Why Was He Removed?
Failure to File Audit Reports
From February 2015 to February 2024 Botha did not submit the required unqualified audit reports for ten straight years. Because of this, he never received Fidelity Fund certificates for the period January 2016 – January 2025.
No Fidelity Fund Certificates
Without those certificates a lawyer cannot legally earn fees from clients. Botha’s lack of certification put both his clients and the Fidelity Fund at risk.
Unpaid Membership Fees
He also failed to pay the LPC’s annual membership fees, owing a total of R33 182, breaking Rules 4.1 and 6 of the LPC Rules.
Ignoring Official Correspondence
Botha repeatedly did not reply to letters and notices sent by the LPC, violating the code of conduct for legal practitioners.
Botha’s Side of the Story
Claim of Resignation in 2015
Botha told the court that in December 2015 he visited the Law Society of the Northern Provinces in Pretoria, handed over all needed documents, and asked to be removed from the society’s roll. He said he then moved to a farm near Mahikeng and stopped practicing law.
Belief That He Was Already Out
He argued that he genuinely thought his resignation had been processed and that he had no clients, no escrow account, and no active files for about ten years.
What the Court Found
No Proof of Resignation
The LPC could not locate any letter of resignation, acknowledgment of receipt, or other correspondence confirming Botha’s termination of membership. Botha produced no documentary evidence to support his claim.
Continued Appearance on the Rolls
Despite his assertions, the LPC’s records showed Botha remained listed as a practicing advocate in the High Court of South Africa, North West Division, Mahikeng, up until his name was removed.
Judgment on Fitness to Practice
Justice Andrew Reddy stated that failing to file audit reports and hold Fidelity Fund certificates for ten consecutive years shows a “profound and sustained disregard” for the basic duties of a lawyer. The court concluded that Botha is not a “fit and proper” person to practice law.
Outcome
The court ordered Botha’s name to be deleted from the LPC’s register. Because the misconduct lasted a full decade, the judges decided that a lesser penalty would not be appropriate—removal from the roll was the necessary sanction.
