Why the DA Wants the NPA to Control Its Own Money

What the National Prosecuting Authority Does

The National Prosecuting Authority (NPA) is the body that decides whether to charge people with crimes and then presents the case in court. Its work is separate from the judges who hear the trials and from the Office of the Chief Justice.

Current Funding Problems

Right now the NPA gets its money through the Department of Justice and Constitutional Development. Because of this setup, the authority often struggles to:
– Fill vacant prosecutor positions
– Provide enough training for new lawyers
– Keep experienced prosecutors from leaving
These issues lead to low conviction rates and a feeling that crime is not being tackled effectively.

Parliament’s Committee Recommendation

In June 2026 the Standing Committee on Appropriations looked at the national budget and said the NPA’s funding model needs a review. The committee suggested two options:
1. Give the NPA its own separate budget vote, or
2. Directly allocate funds to the NPA so it can manage the money itself.
The committee noted that the NPA’s prosecutorial role is different from the judicial work of the courts, which supports the idea of independent funding.

DA’s Push for Change

DA justice spokesperson Advocate Glynnis Breytenbach welcomed the committee’s recommendation. She said the DA has long argued that the NPA should have financial and administrative independence. In a letter to Minister Mmamoloko Kubayi, Breytenbach reminded the minister that the DA asked for a direct budget transfer back in June 2026 and has not yet received a reply.

How Financial Independence Could Help

Breytenbach explained that if the NPA controlled its own budget it could:
– Hire more prosecutors to fill empty posts
– Offer regular training and skill‑building programs
– Retain experienced lawyers by offering better resources and career paths
All of these steps would boost the NPA’s capacity to prosecute cases and improve conviction rates, making communities safer.

What the DA Asks the Minister to Do

The DA’s letter calls on Minister Kubayi to:
– Start the legislative and administrative steps needed to create a separate budget vote for the NPA
– Work with the Minister of Finance and National Treasury to move funds directly to the authority
– Consider changes to the National Prosecuting Authority Act and other laws to guarantee the NPA’s financial and administrative autonomy
– Provide a clear implementation plan with timelines and report progress to Parliament

Breytenbach stressed that fixing South Africa’s prosecution challenges is a big job, but the current parliamentary recommendation offers a real chance to act. She believes that giving the NPA control over its own finances will help the authority rebuild its strength, increase conviction rates, and keep South Africans safer.
