Zurenah Smit’s bail application has been rejected as there continue to be delays in psychological assessment

Date:

Overview of the Case
Smit’s mental health assessment is still pending, and her bail reinstatement request was removed from the Western Cape High Court docket. She is currently being held in the hospital section of Pollsmoor Prison after her bail was revoked earlier this year.

Who is Smit?
Smit is a defendant in a criminal trial. During the trial she testified that her late husband picked her up when she felt ill. The State cross‑examined her on this point, which led to concerns about her mental state.

What happened?
After the cross‑examination, Judge Derek Wille ordered that Smit’s bail be revoked. He directed that she be sent to Valkenberg psychiatric hospital for a 30‑day evaluation to see if she can participate in the court process.

Bail Revoked and Waiting for Psychiatric Evaluation

Judge Wille’s order
The judge said that, pending the outcome of the report required by sections 78 and 79 of the Criminal Procedure Act (CPA), Smit must stay in custody until Valkenberg completes its assessment.

Waiting list at Valkenberg
Smit is currently fifth on the waiting list for Valkenberg. Her legal aid lawyer, Susan Kuun, pointed out that since her bail was revoked on January 28, she has moved up only one spot on the list. She has been waiting 138 days for an expedited admission, and it is still unclear when she will be accepted.

Legal Arguments

Defense lawyer Susan Kuun
Kuun argued that keeping Smit in a correctional facility is unnecessary. She said Section 79 of the CPA allows the court to refer a person to a psychiatric institution without requiring detention in prison. Kuun warned that, at the current pace, Smit will spend more time in prison before being transferred to Valkenberg.

Prosecutor Renee Uys
Uys disagreed that the defense’s request was a bail application. She said Judge Wille’s referral was made in good faith and became necessary because of Smit’s conduct on January 28, when the trial was already underway and she was under cross‑examination.

Acting Judge Van Leeve
The acting judge noted that Judge Wille’s order explicitly stated that Smit must remain in custody “until the report” from Valkenberg is ready. He concluded that the bail reinstatement request was premature and should be made only after the psychiatric report is received. Consequently, the matter was taken off the court docket.

Current Situation

Where Smit is held
Smit is staying in the hospital area of Pollsmoor Prison, where she is not under regular observation.

Next court date
She is scheduled to appear in court again on June 19, pending the outcome of her Valkenberg evaluation.

Conclusion
Smit’s case highlights the tension between ensuring a fair trial and addressing mental health needs. While the defense argues that prison is not the right place for her while she awaits psychiatric evaluation, the prosecution and the acting judge stress that the court’s order must be followed until the Valkenberg report is available. The next hearing in June will likely shed more light on whether Smit will be transferred to the psychiatric hospital soon or remain in custody for a longer period.
